Virginia-based lender Capital One is facing accusations of engaging in unfair, unlawful and deceptive practices with regard to its credit cards and their rewards in a proposed class action lawsuit.
The proposed class action lawsuit says Capital One wrongfully canceled credit card accounts of the plaintiffs, who include NTech Consulting LLC and Nikhil Navkal.
According to the proposed lawsuit, Capital One also refused to release the rewards that had already been legitimately earned by the plaintiffs after closing their accounts.
“Plaintiffs and Class Members earned credit card rewards using their Capital One reward cards but were denied their earned credit card rewards when Capital One canceled their credit cards pursuant to an undisclosed rewards cancellation policy. Plaintiffs and all Class Members were injured by Capital One’s rewards cancellation policy.”
According to the proposed class action lawsuit, Capital One’s actions amounted to a breach of the terms of the agreement as the plaintiffs were in full compliance when their credit cards were canceled.
“Capital One’s policy and its actions in canceling and denying Plaintiffs and other Class Member cardholders their earned credit card rewards is a breach of contract (including a breach of the duties of good faith and fair dealing), a deceptive and unfair practice and results in unjust enrichment to Capital One.”
The proposed class action lawsuit also says that Capital One closed the plaintiffs’ credit card accounts without informing them of the reasons. Among other things, the plaintiffs in the proposed class action lawsuit are seeking to be awarded damages by Capital One.
The proposed class action lawsuit is seeking a trial by jury.
